Tesla, the electric vehicle maker, recently settled a racial discrimination lawsuit brought by Owen Diaz, a Black man who worked as an elevator operator at its Fremont, California factory in 2015. The lawsuit, in which a federal jury awarded Diaz $3.2 million in damages, alleged racist discrimination and harassment of Black workers at the automaker.
Continued Allegations of Discrimination
Attorney Lawrence Organ, who represented Diaz, stated that the settlement terms are confidential. However, he mentioned another ongoing class-action lawsuit, Marcus Vaughn v. Tesla Inc., which alleges continued racist discrimination and harassment of Black employees. Despite the legal battles, Organ emphasized the importance of individuals standing up against such behavior, even at a company as large as Tesla.
Racism in the Workplace
During the trial, Diaz testified about the racist epithets used by his colleagues, the hostile work environment, and the derogatory comments directed at him and other Black workers. The lawsuit also highlighted instances of racist graffiti and drawings targeting Diaz and his son, who also worked at Tesla.
The initial jury verdict awarded Diaz $137 million in damages, which was later reduced to $15 million by the judge before reaching the final settlement amount of $3.2 million. Despite the legal victories, the attorney representing Diaz questioned why Tesla CEO Elon Musk had not taken more decisive action to address the ongoing racist behavior within the company.
Call for Change
Organ expressed disappointment in Musk’s failure to address the issue despite multiple verdicts against Tesla. He called for a clear commitment from Musk to end racial discrimination and harassment at the automaker, emphasizing that civil rights laws can only be effective if individuals and companies are held accountable for their actions.
The settlement with Diaz comes at a time when Musk is facing criticism for his handling of hate speech on X, the platform formerly known as Twitter, which he owns and operates. Reports of Musk sharing unverified claims and derogatory statements have fueled concerns about his leadership and commitment to promoting equality and inclusion.
